For decades, the All India Muslim Personal Law Board has thundered against the Uniform Civil Code. Civil war. Mayhem. Attack on faith. Serious threats. But here are two simple questions: What exactly is Muslim Personal Law in India? And why has it never been codified clearly till date?
You cannot claim something is sacred and non-negotiable while refusing to define it. Article 44 of the Indian Constitution mandates that the State shall endeavour to secure a Uniform Civil Code for all citizens.
So the question is straightforward: The Shariat Application Act of 1937 refers to Sharia, yet does not specify its provisions. Even judges struggle to identify what precisely constitutes Muslim Personal Law.
Opacity breeds arbitrary rules and tyranny! It endangers non-Muslim women who end up marrying Muslims. If Muslim Personal Law is divinely ordained, codify it. Put it on a website. List the fatwas you consider binding. Let every citizen read it in plain language.
Secrecy fuels distrust. You cannot demand special protection for a law you refuse to define. The time for evasiveness is over. All Islamic countries have codified it. Why are Muslims in India so secretive? Time to let the world know the exact provisions of Muslim Personal Law.
